Terms & Conditions — Pluggy & V2G Australia

Entities: Pluggy Pty Ltd (ACN 677 142 228 ) and V2G Australia Pty Ltd (together, we, us, our).

By creating an account or using our apps, websites, charging services or integrations, you agree to these Terms.


1. Acceptance of Terms & Updates

1.1 These Terms govern: (a) the Pluggy platform and public charging network access; (b) the V2G Australia home-charger control app; and (c) our websites and related services.
1.2 You accept these Terms when you register, start a charging or discharging session, or use any part of our apps or sites.
1.3 We may update these Terms and our Privacy Policy to reflect laws, features or operational changes; the latest version applies to your continued use. We’ll make updated Terms available in-app and on our websites. chargefox.com


2. Eligibility, Accounts & Your Responsibilities

2.1 You must be legally capable of entering these Terms (generally 16+ or 18+ per local law) and provide accurate, current details.
2.2 You’re responsible for all activity under your account, keeping credentials secure, and promptly updating payment and contact details.
2.3 If you add a vehicle or VIN, you warrant you’re authorised to control it and will remove it if that changes. chargefox.com


3. Services Overview

  • Pluggy (public network): Find, access and pay for charging at participating sites operated by Pluggy and/or independent charge point operators (CPOs).
  • V2G Australia (home control): Start Charge, Discharge, Stop; view state-of-charge (%), energy transferred (kWh) and live rate (kW). Works with Numbat (free integration) and Infypower (optional upgrade); more compatible chargers are coming.

Part A — Pluggy Public Network

4. Using Public Charging

4.1 Sessions & Fees. You agree to pay session fees advertised for each charger (e.g., per-kWh) plus any applicable idle fees for overstaying once charging completes, and taxes. Review your statements and raise disputes promptly. If a payment fails, we may suspend your account and pursue overdue amounts. chargefox.com
4.2 Availability. Chargers may be unavailable or interrupted (maintenance, upgrades, site power issues, safety). We can restrict or suspend access where reasonably necessary. We do not guarantee compatibility with your EV or a successful/ timely charge. chargefox.com
4.3 Safety & Fair Use. Use chargers only for EV charging and in line with laws, EV manuals, site instructions and parking restrictions. Unreasonable or improper use may result in suspension (examples: misuse, fraud, interference with equipment or service). Ensure the connector is suitable for your EV and your EV is roadworthy. You use chargers at your own risk and must follow property rules at private sites. chargefox.com
4.4 CPO Sites. Many public chargers are owned/operated by third-party CPOs. When you use those chargers, their terms also apply. If there’s any inconsistency, the stricter requirement for you may prevail. We aren’t responsible if linked CPO terms are outdated—check the most recent version before use. chargefox.com

5. Carbon Abatement & Environmental Attributes

Any environmental attributes, emissions reductions or carbon-credit rights that arise from the use of our products or network are retained by us (or our nominee), unless a CPO’s specific terms say otherwise. We may create, hold, trade or assign those rights; you must not create competing interests in them. chargefox.com


Part B — V2G Australia Home Charger Control

6. Home Charger Commands & Data

6.1 Commands. The app lets you send Charge, Discharge and Stop commands, and see live metrics (battery %, kWh in/out, kW rate).
6.2 Compatibility. Supported hardware includes Numbat (no extra fee) and Infypower (paid add-on). Compatibility can vary by model/firmware; support for more V2G-ready chargers is planned.
6.3 Safety. Follow the charger manufacturer’s instructions and your EV manual. You are responsible for local wiring compliance, safety, export controls (if applicable) and any utility/market participation rules when discharging to home or grid.
6.4 Grid Programs. If you enrol in tariffs, demand response, or export programs, additional terms may apply from your retailer, DNSP or market operator.


7. App & Website Use (Both Apps)

7.1 Content & IP. Our apps/sites and their content (text, UI, logos, code) are owned or licensed by us and are provided for general information only; we may update or remove content at any time. No scraping, reverse engineering or data-mining except as allowed by law. chargefox.com
7.2 Links. Linked third-party sites (including CPO pages) have their own terms and privacy policies. Access them at your own risk; we’re not responsible for their content or accuracy. chargefox.com
7.3 Access & Security. We don’t promise uninterrupted access. Internet communications can be intercepted; while we take reasonable precautions, we can’t guarantee transmission security or continuous availability. chargefox.com


8. Payments, Subscriptions & Billing

8.1 You authorise us (and our payment processors) to charge your saved payment method for session fees, subscriptions, idle fees, and taxes. Keep your payment method valid.
8.2 We may offer bundles, credits or subscriptions; specific terms apply and will be shown at purchase.


9. Privacy

Your personal information is handled under our Privacy Policy (see app/website). If you use a third-party CPO charger or third-party program, their privacy terms may apply as well. chargefox.com


10. Warranties, Consumer Law & Liability

10.1 As-is / As-available. Services are provided “as is” and “as available.” We disclaim implied warranties to the maximum extent permitted by law.
10.2 ACL. Nothing excludes your Australian Consumer Law rights. For major failures you may cancel and seek a refund for unused services/credits; for non-major failures you’re entitled to timely remediation or a refund if not remedied. chargefox.com
10.3 Limits. To the maximum extent allowed, we are not liable for indirect or consequential loss (e.g., lost profits, data, opportunity), EV damage caused by not following manuals or instructions, or events outside our control (power/telecom outages, force majeure, third-party acts). Where liability cannot be excluded, it’s limited to the extent permitted by law. chargefox.com


11. Indemnity

You indemnify us from losses arising from your breach of these Terms, misuse of services, or failure to follow EV/charger instructions or laws—except to the extent caused by our gross negligence or wilful misconduct. chargefox.com


12. Suspension & Termination

We may suspend or terminate your account (acting reasonably) for breach, fraud, safety, non-payment or unlawful use. You may close your account at any time. Clauses on fees due, IP, privacy, liability limits and indemnities survive termination. chargefox.com


13. Competitors

If you provide comparable services, you may not access or use our apps/sites or content without our written consent. chargefox.com


14. Force Majeure

We’re not responsible for delays/failures due to events outside our reasonable control (e.g., natural disasters, pandemics, outages). chargefox.com


15. Governing Law & Disputes

These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the courts of Victoria and the Commonwealth of Australia. CPO terms may nominate different jurisdictions. chargefox.com
